Thank you for using Settlement Online!

Please read these terms carefully, and contact us if you have any questions.

Settlement Online programs and services are provided by ISANS and other settlement agencies across Canada. By using our Services you agree to be bound by these Terms of Use. The most current version of the Terms of Use can be reviewed by clicking on the "Terms of Use" hypertext link located by clicking on the ABOUT link of our Web pages. Settlement Online reserves the right to update the Terms of Use at any time without notice.

Eligibility

In order to use Settlement Online, you must:

• be at least eighteen (18) years old and able to enter into contracts;
• complete the registration process;
• agree to the Terms of Use; and
• provide true, complete, and up to date contact information.

By using Settlement Online, you represent and warrant that you meet all the requirements listed above, and that you won’t use Settlement Online in a way that violates any laws or regulations of Canada. ISANS and Settlement Online partner agencies may refuse service, close accounts of any users, and change eligibility requirements at any time. All contracts are legally binding under the laws of Nova Scotia.

Term

The Term begins when you first sign up at settlementonline.ca and continues as long as you Settlement Online programs and services. By clicking the button and entering your username means that you “digitally sign” and agree and accept these Terms of Use.

Changes

ISANS may change any of the Terms of Use by posting revised Terms of Use on our Website and/or by sending an email to the last email address that you have provided. Any new Terms of Use will be effective immediately and apply to any continued or new use of Settlement Online. ISANS may change programs and services, including any updates, enhancements, new features, and/or the addition of any of its web content at any time without notice.

Account and Password

It is the responsibility of “you” the user for keeping your account name and password confidential. It is your responsibility to immediately notify us of any unauthorized use of your accounts. Settlement Online is not responsible for any losses due to stolen or hacked passwords. Settlement Online does not have access to your current password, and for security reasons, we may only reset your password.

Closing Your Account

You or staff using Settlement Online may terminate this Agreement at any time and for any reason by giving Notice to the other party. If you don’t log in to your account for 12 or more months, your account and all the data associated with it may be treated as inactive and permanently deleted.

Privacy

ISANS and Settlement Online partner agencies retain the right to use and disclose your information according to the following:

Any personal information you provide through our website will be used only for the purposes for which it was collected.

• Settlement Online does not use cookies in any manner which could impinge on your privacy (i.e. it does not use “snoop” software).
• Settlement Online administrators may contact you by e-mail or in a general notice on the site.

Settlement Online website has links to outside web pages which are out of our control. Please be aware that ISANS and Settlement Online partner agencies are not responsible for site content outside Settlement Online, or their privacy policies. We encourage you to read the individual privacy statements on any website you visit.

Web Pages and Links

Hyperlinks from Settlement Online to other sites have been provided in good faith, but do not indicate an endorsement by ISANS or Settlement Online partner agencies of those sites, which are subject to change over which ISANS and Settlement Online partner agencies have no control.

Security

ISANS and Settlement Online partner agencies care about the security of our users while we work to protect the security of your account and related information, Settlement Online cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account. 

Notice of Breach of Security

If a security breach causes an unauthorized intrusion into our system that materially affects you, then Settlement Online will notify you as soon as possible and later report the action we took in response.

General Rules

Acceptable Use Policy

Our Acceptable Use Policy sets some rules that you have to follow as a Settlement Online user. Some are dictated by the law, some are common sense.

If you violate any of these rules, then Settlement Online holds the right to suspend or terminate your account.

Use of Site

You promise to follow these rules:

• I will register for only one account.
• Answers to assessments, quizzes, and other assignments will be my own work
• I will not engage in any other activities that will dishonestly improve my results or dishonestly improve or hurt the results of others.
• I won’t send Spam! By “spam,” we mean “unsolicited email.” If you send people mass email without their permission, you’re spamming.

You are prohibited from using Settlement Online to share content that:

• Contains illegal content or promotes illegal activities with the intent to commit such activities.
• Contains credible threats or organizes acts of real-world violence. We don’t allow content that creates a genuine risk of physical injury or property damage, credibly threatens people or public safety, or organizes or encourages harm.
• Harasses others. Abusive or otherwise inappropriate content directed at private individuals is not allowed.
• Violates intellectual property, privacy, or other rights. This includes content that you do not have the right to share, claim content that you did not create as your own, or otherwise infringe or misappropriate someone else’s intellectual property or other rights. You must always attribute materials of others used or quoted by you to the original copyright owner.
• Spams others. Do not share irrelevant or inappropriate advertising, promotional, or solicitation content.

You also aren't allowed to:

• Attempt to access any other user's account.
• Reproduce, transfer, sell, resell, or otherwise misuse any content from Settlement Online, unless specifically authorized to do so.
• Access, tamper with, or use non-public areas of our systems.
• Break or circumvent our authentication or security measures or otherwise test the vulnerability of our systems or networks.
• Try to interfere with any user, host, or network, for example by sending a virus, overloading, spamming, or mail-bombing.
• Use our Services to distribute malware.
• Impersonate or misrepresent your affiliation with any person or entity.
• Encourage or help anyone do any of the things on this list.

Settlement Online administrators in its sole discretion may block or remove any or all communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable by Settlement Online administrators.

Reporting Abuse

If you think anyone is violating any of these Terms, please notify us immediately. If you received spam you think came from a Settlement Online user, we want to hear about it. Please report it to our staff. If you think anyone has posted material that violates any copyrights, then you may notify us according to our Copyright Policy.

Indemnity

You agree to indemnify and hold us and our Team harmless from any losses (including attorney fees) that result from any claims you make that aren’t allowed under these Terms due to a "Limitation of Liability" or other provision. You also agree to indemnify and hold us harmless from any losses (including attorney fees) that result from third-party claims that you or someone using your password did something that, if true, would violate any of these Terms.

Computer Viruses

Most material available from Settlement Online is in a “text-file” form which cannot contain or transmit computer viruses. Some pages, however, such as Word files, are in “binary” form, which can, like downloadable executable files, transmit viruses. Although ISANS and Settlement Online partner agencies make every effort to exclude computer viruses from its materials, you should take measures to check for computer viruses, execute due caution when downloading executable files, and make certain you have a comprehensive and recent backup of the information stored on your computer.

Copyright Policy

You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. The information obtained from or through this website is provided as guidelines for using works for educational purposes and is not intended to constitute legal advice. Unless otherwise stated, all content on this site, including text, graphics, logos, publications and images, is owned by ISANS and is protected by Canadian copyright laws and international copyright treaties and agreements.
